If someone is smoking outside and it bothers you, move 2 feet away... problem solved.
If you feel that this person should be fined and new laws written to ensure that you never again need to move 2 feet to avoid that terrible, day-ruining exposure to the smell of smoke, then you are most likely the one with the problem, not the smoker.
