This is an outrage.
Meaning he will probably pay back just a fraction of the money plus a $1,000 fine. They never did find that money so while he is found guilty of stealing, he gets NO jail time AND he can still use the money he stole because he hid it well.Quote:

He attempted suicide a few weeks ago if that doesn't scream guilty. This is a joke. The audit they did after this first happened found that the Sheriffs department has a lot of evidence missing such as guns, computers, etc. that was logged in but found missing so he didn't even run his own department very well.
The biggest thing is why when escorting that much money do you stop at home to close a garage door? Call your wife, friend, or neighbor! Just seems really conveinent for the money to be missing and th guy transporting it made an unescorted stop on the way back to its destination.

People need to ask themselves why cops don't do time. And forget about this particular example of cop grease.
Again, a great precedent to set. Just because cops could have some issues in jail because of who they are, we don't punish them as we would someone else that committed the same (or less) crime.
That's a load of crap - this man got off way to easily.
The system has flaws - period.
Berryman's sitution involved a crime of violence. It's a little different.
That being said, this cop should have served at least some jail time.
If people got a year everytime they hit a guy there would be some pretty crowded jails... I think the main difference is race and the kind of lawyer 120k in cash can buy...

I have not read the sentencing memorandums and the presentence report, so I am not qualified to make an intelligent read on what the sentence ought to have been. However, it does not appear that the prosecution objected to the sentence handed down by the court.
As for the restitution, since the restitution amount is undetermined, that means that there is insufficient evidence to date to determine the amount of the loss.
If the jury did not detemine the amount of the loss, that might have a direct bearing on sentence imposed.
