Are. You. Kidding. Me.
Pro-freaking-bation??? He took 10x more money than someone would get by robbing a bank.
This is an outrage.
Meaning he will probably pay back just a fraction of the money plus a $1,000 fine. They never did find that money so while he is found guilty of stealing, he gets NO jail time AND he can still use the money he stole because he hid it well.Quote:
Gilbert will be required to repay an undetermined amount of money under the sentencing order. He will also pay a $1,000 fine and be required to complete 150 hours of community service, details of which will be determined later.
Gilbert showed no reaction when the order was read.
First of all, the law is held to an entirely different standard when they break the law. That doesn't bother me at all. Those guys should never have to do any real time. Invent a cop prison/country club for them if we really need to incarcerate.
Second, Berryman more than likely got done by a republican judge with political aspirations. Had to be hard on crime.
I suggest that the people of Dallas county file this one away for the next election when this judge comes up for re-election (if he does...not sure if that's just federal judges or what)
What a crock!
He attempted suicide a few weeks ago if that doesn't scream guilty. This is a joke. The audit they did after this first happened found that the Sheriffs department has a lot of evidence missing such as guns, computers, etc. that was logged in but found missing so he didn't even run his own department very well.
The biggest thing is why when escorting that much money do you stop at home to close a garage door? Call your wife, friend, or neighbor! Just seems really conveinent for the money to be missing and th guy transporting it made an unescorted stop on the way back to its destination.
Well, clearly I chose the wrong career path. I shall work to become a police officer. Then, I will take down the Federal Reserve in Kansas City.
Only to get some probation or a few years in prison country club yet still keeping most of the money I took. Yay for me! :rolleyes5cz:
What an excellent precedent to set, in the words of Marty...
That's a bad job outta you, judge.
People need to ask themselves why cops don't do time. And forget about this particular example of cop grease.
Again, a great precedent to set. Just because cops could have some issues in jail because of who they are, we don't punish them as we would someone else that committed the same (or less) crime.
That's a load of crap - this man got off way to easily.
The system has flaws - period.
Berryman's sitution involved a crime of violence. It's a little different.
That being said, this cop should have served at least some jail time.
If people got a year everytime they hit a guy there would be some pretty crowded jails... I think the main difference is race and the kind of lawyer 120k in cash can buy...
I disagree strongly with that statement.
If you had said that if you have money, you usually get a better deal, I would agree. For the record, Motgomery Brown, Gilbert's attorney, is not a slouch.
I have not read the sentencing memorandums and the presentence report, so I am not qualified to make an intelligent read on what the sentence ought to have been. However, it does not appear that the prosecution objected to the sentence handed down by the court.
As for the restitution, since the restitution amount is undetermined, that means that there is insufficient evidence to date to determine the amount of the loss.
If the jury did not detemine the amount of the loss, that might have a direct bearing on sentence imposed.
I don't think race had much to do with Jason's case, at least not nearly as much as his being a highly visible athlete and a judge who wanted to make an example of him.
or the kind of judge*..... :rolleyes5cz:

Ok fine! I'll say it!!
The judge was paid off! Hear me world? He took the coin! Sold his soul to Satan. Made a deal with the devil. He got himself an offshore account and is cashin' it in.
Anybody got a problem with that or want to accuse me of libel, you can find me and my hairless head in my new house in Grimes, IA.
Just bring a treat for Sassy & Hazel
(man, that feels good to get off my chest)
