I think the judge writing for the majority nails it That is fundamentally the disagreement here. I, and others, think that not disenfranchising a single voter is worth the risk of some vague threat of voter fraud which would be illegal anyway.
Other think that it's worth not letting some people vote if it lowers the risk of voter fraud. (I'm assuming they are not including themselves in the "some people" category).
The problem is that there is a third category of Republican operatives who abuse the voter fraud fears in order to push through laws that are specifically designed not to limit voter fraud, but to disenfranchise a segment of the population that votes overwhelmingly Democratic. To quote the dissenting judge in on the Seventh Circuit: I also find it interesting that there is no identification requirement on absentee voting under the Indiana law. Wouldn't absentee voting be the most prone to fraud? Ooooooooo Republican operatives? Sounds scary | |

The House of Representatives passed the Federal Election Integrity Act, which required voters to show photo identifcation in federal elections by 2008 and show proof of citizenship by 2010. However, the legislation never became law because the Senate never scheduled it for a vote.

My point is the constitution is open to interpretation. This is risky IMO because where does the interpretation end, and solid rules begin? I'm not even convinced that this is a federal constitutional issue. Federalists abhor the intrusion into state election procedures and believe this issue should be determined by the individual states and not the federal government.
