I actually think its a valid point especially if the players have the face/body characteristics of that game player.

I doubt he'll win the case, but I think that those games are set up to look like NCAA students.

I saw this on another board the other day and am quite frankly on the fence about it.
He has a very valid point that EA uses nearly exact likenesses of the players at each position and jersey number and the NCAA does nothing to stop them.
EA has been challenged with these lawsuits before and it either fails completely or they settle with the plaintiff and continue their ways.
Personally what I would like to see is EA donate to a general NCAA scholarship fund and then use the actual player names. It keeps the players from being compensated (which is the issue) but the donation creates some goodwill with the NCAA.

I beg to disagree, what fun would the game be if all the players were randomly colored and sized?
We all buy these games because they DO have characteristics of the student-athlete. Please explain how this is a violation of anything?

Why would you hold this against Nebraska? This guy is primarily an Arizona State guy. He played three years at ASU amd maybe eight games for Nebraska before he went down with an injury, and most over there would say he was a total and complete flop and they wish he never would have transferred there.
He is probably the "poster boy" for why schools should shy away from bringing in a guy late in his college career, especially if there appears to be some baggage.

I think he makes a valid point; whether that equates to a strong argument in court, I'm not so sure. I would actually like to see him win this lawsuit and hope the NCAA doesn't get dropped from it.

EA Sports is using the likenesses of real people to build a commercial product, and not compensating those real people for this use. It's pretty hard for EA Sports to argue that they're not using the likenesses of these athletes. I have no idea if Keller has a valid legal argument, though.

This whole conversation reminds me of when I played, possibly Ken Griffey for SNES, that everyone had a name and number except for LF for the Giants. God I hated that a-hole. It still looked and had the stats like him but it didn't have his name. Don't think he was in the MLB union.

Yeah, there are some players and even coaches who won't agree to having their name and likeness used in those video games. Bill Belichick won't let his name be used in Madden because he's not a member of the coaches union or something like that. (Is anybody really surprised that Bill Belichick feels the need to make himself a special case?)

Any coach for the Cowboys was the exact same way. Some of the more popular coaches in the NFL have never joined the coaches association.
