(A)(1) No person shall operate any vehicle, streetcar, or trackless trolley within this state, if, at the time of the operation, any of the following apply: (a) The person is under the influence of alcohol, a drug of abuse, or a combination of them.- (this is the first item in the "charge summary")
******************************************************************************** ******************* (h) The person has a concentration of seventeen-hundredths of one gram or more by weight of alcohol per two hundred ten liters of the person's breath. (this is the third item in the "charge summary")
These are alternative grounds. If the test gets suppressed and the prosecution can no longer prove a per-se violation using the BAC, the prosecution can still proceed with the charge by proving "under the influence" by other evidence such as the results from field sobriety tests, the defendant's behavior, items found in the car, etc.

That's his first offense OWI he was hired prior to the OWI and ISU can't and won't let him go. Any further issues could result in termination. It seems like from the updates I've seen that Hoiberg really wants him. Personally, I don't get this one. They're after some major talent in 2012. Why use a scholarship on a kid that is not going to play much next year. Henton seems to me to be an Ejim-type player. Maybe a little bit better ball handler and a little less athletic? Freshmen that sit the bench the entire year usually end up transferring. With the new assistants, ISU looks to have a dynamic recruiting staff. Why not hold the scholarship for players like Okoro, Niang, Abrahamsson or even a Staten/Gessell instead of bringing in a player that isn't going to help you in 2011.

Why do you believe his name should not be listed with players like Okoro, Niang, and Abrahamson? It is probable Henton in 2012 would make a bigger impact than a freshman. Holding the scholarship makes ZERO sense. You do not turn down a player in 2011 for a similar player that may not sign in 2012.

I don't think we want to hold scholarships unless we can't fill it with a quality player. Henton would not fall into that category. He may not play big minutes next year, but that doesn't mean he couldn't be productive and worthy of a ride.

ISU is not to the point where you don't use a scholarship on a player because he wont play as a freshman. Actually no team is to that point, no teams plays every player.
