But I’m pretty sure under NY Times v. Sullivan and Gertz that HB would have to show what is called actual malice in order to win a lawsuit against Miller or Kxno. The Court defines this as either purposely spreading info one knows to be false or a reckless disregard for the truth (more than simply failing to meet professional journalistic standards). These cases involve libel (written), as opposed to slander (spoken), but it is my guess that any court would apply the same – if not an even looser – standard.
It’s certainly not impossible to prove actual malice, but it’s designed in part to be a difficult standard to meet. After all, public figures (like HB) can easily respond to any false allegations. Thus, under my VERY much NOT professional opinion, HB would have a very difficult case. Given that it’s hard to imagine any worthwhile damages that he suffered, I can’t imagine it turning into a lawsuit.
Then again, if HB signs with ISU, I may consider an amendment to the Constitution that makes an HB exception to the First!!! :biglaugh:
