I feel terribly for these parents, but how is facebook responsible?

Seems like they might be throwing things at a wall and seeing if anything sticks. The medic? Sure. his employer? maybe. The city? The owner of the building? That seems like a huge reach.

The EMT who posted the pic is sick. Other than that I don't see anyway FB is at fault for this.

Facebook owns the photos when they get uploaded to their servers.

They have no case against Facebook. But, they do have a case against the EMT.

The problem for the parents is that the EMT doesn't have deep pockets.

Definitely seems like they are going after everybody and hoping to get something... There is no foreseeable way that they get anything from Facebook...

Facebook backlogs the photos uploaded to their site, so by keeping the image, they are still hosting the photo.


I don't necessarily agree with suing the company for it, but they do keep deleted photos on file (and still accessible) for long periods of time before the purge them.

I think they aren't looking at money as much as they are looking to get that picture purged from what the family has said.

This is a horrible story..glad Im from Iowa

Might as well sue all the internet companies for allowing the data to be transferred over their equipment. And then sue Al Gore for inventing the internet.

They could also sue the makers of the tubes that make up the series of tubes that is the internet.

In a case like this, why would facebook even fight to prevent the picture from being removed? It seems like it would be the decent thing to do.

The article says that the photo has been removed. They are suing facebook in part to attempt to find out who all downloaded it.
