I think there is an option for unisex rooms, but no one is forced to use it - I think, otherwise, this is the dumbest move ever.

I don't see why the liability would be any different than any other public restroom facility. Rape, assault and "peeping" can certain happen (and has) in uni-sex bathrooms.
