I'm pretty sure 99 out of 100 are less than 12 inches.

Yeah, I'm going to sue my lumber yard as well. Afterall, my 2x4's are only 1 1/2" x 3 1/2"!

That's a really bad comparison. It's widely known, advertised and an industry standard that 2x4's are not actually 2"x4" - there is no deception there.
Subway has never (to my knowledge) indicated or made known that their sandwiches are not actually 12".
A better comparison would be cars rated for fuel economy and then you find out after buying it that the ratings were wrong. The point is that it is a nominal measurement. People are seriously deluded if they think that getting a footlong sandwich or a footlong hotdog means they will get 12".
The auto industry is protected since it is the government that has determined how fuel economy is measured and both the industry and the government know that it is nowhere near an accurate measure of what a vehicle will do on the road.

If Subway didn't bake the bread in house they would have better quality control. All the bread should be baked in one location, measured, then shipped to the Subways throughout the world. -

Uhh, color me not surprised. And here's why. If the mold is 12 inches, it is pretty much impossible for it to be longer than 12". And if the person doesn't make it perfectly it will be slightly less than 12". But since the max is 12" there are no longer loaves to even it out, and the average can only be less than 12".

Does Subway actually advertise 12"? I know they have a 6" sub, but it's always been referred to as a footlong, as I can remember. Which probably has some loophole in it.
