Penny ain't dead. My guess is yes, Ben intended on killing her, but after he saw little Charlie, he couldn't do it.
Oh, and Penny is smoking hot.

I just wanna watch it in HD again. I could care less about basketball this season as compared to Lost.

Has there ever been any evidence of Ben showing any consideration or morality in the past. Heck he just told Jack he didn't care if the rest of the passengers died in getting him back to the island!

If Ben saw little Charlie, it would have been more in Ben's character to kill Penny and take Charlie as his own son. I don't think he killed Penny though.

I don't think Ben killed Penny. Penny was not in LA. I think his unfinished business might have been with whoever tried to kill or attack Sayeed or his new wife.

I think he clearly went after Penny once he new Desmond was in town. He even mentioned something about not only unfinished business but following up on a promise to someone. He promised Whiddmore he'd kill Penny.

And John says something like "you've just killed everyone on that boat" and Ben says "that's not my problem".

EDIT -- I don't think the woman with Sayid was his wife. It looked to me like she was escorting him in handcuffs. I could be wrong, but I thought that's what I saw.
MINOR SPOILER IF YOU DIDN'T WATCH THE PROMO FOR NEXT WEEK...
She's shown talking to Locke in the promo for next week's episode, so we'll probably find out more then.

I still don't think Penny was killed, could be wrong though. I don't think Penny could have wounded Ben that bad. Ben could have just shot her due to lack of time. I think something else happened that we don't know.
