If there a more qualified candidate got the job, a less qualified minority would not have a case to persue. These rules state that you can't use race, sex, ethnicity, etc..., to choose between 2 equally qualifying candidates. You don't have to hire the minority just because he/she applied if they aren't the best qualified candidate for the job. All you have to do is prove that you gave an equal opportunity and hired the best candidate you found based on qualifications and experience.

I know some VERY lazy skinny people, they just don't eat like I do.

I can assure you I am quite skinny, rather slovenly, and I probably eat much more than most people. In fact in my current and former jobs I am known for my powress with a fork. When KFC had the 10 piece bucket deal last year I went with some co-workers, ate my own bucket, polished off a buddy's, and ate 2 biscuits. I can take a six pack and a pound in one setting without breaking a sweat.

That being said I've also done Ferrall's, and only broke the meal plan once during my 10 weeks. I love to eat as much as anybody I know but it can be done and it isn't that hard if you put your mind to it.

In way too many cases, it isn't who is the best candidate or the most qualified. A lot of times it boils down to who plays the game the best. You know, the one with all the right answers at the interview, the one who knows who to schmooz and who's buttons to push at what time, the one who says or does one thing with co-workers and is completely opposite with superiors, the one who knows how to manipulate the system.

That being said, I also wonder if there are obese people being discrimated against for their appearance? Looks play a huge part in the success rate of people in this country.

Knowing someone is the biggest part of getting the job. I have seen a lot of people hire who know a supervisor or are a cousin of so and so, etc.

As chadm said, however, different weights are right for different people. Your body frame has a good deal to do with it - someone with a big frame (an endomorph) is going to carry the exact same weight on the exact same height a lot differently than someone with a small frame (an ectomorph). I know chadm, and he's not overweight.

I actually run 5 miles a day and I am still chubby. The original question was not a body type question. I relize people have different body types. Even when I was a Marine I was still a big guy. Right now I am about 205 and go about 6'2. Still have a small belly that will never go away. It's more lose skin with bad genetics. I am talking huge, can't control what you eat type people and my original question has been awnsered.
