At this point it's looking a lot like a "he said, she said" scenario. Maybe he did, maybe he didn't. But considering what happened in the Duke rape case and Eric Frimpong case, and comparing that to what has gone on in Iowa City in recent (and not-so-recent) years, my gut would have me side with Roethlisberger on this one - at least for right now. And as that appears to be the case, I think it should be thrown out of court immediately. Without the criminal case it just appears to be a moneygrab, and if this is allowed to go to court and she wins, virtually no man would ever be safe from a rape civil suit ever again. What if there was a criminal case and he was acquitted? Should the civil case be able to proceed or should it be thrown out?

Not saying that she is in fact lying. But she sure as hell isn't setting herself up to be proven to be telling the truth either.
A full year? No criminal charges? I can't imagine what evidence would be available to show the incident occurred?
Unfortunately - Rothlisberger will probably settle with her seeing that a court case will cost more.

If there was a criminal case I'd be much less inclined to argue against a civil case, even if he was acquitted on the criminal case (pending the details of the acquittal). However, no criminal charges were ever filed, then or now, and instead she's going straight for his money. To me something smells fishy...

The other thing to keep in mind is that there is a different standard of proof for a civil case than a criminal case. A criminal case requires proof "beyond reasonable doubt", while a civil case only requires "clear and convincing" evidence.
Perhaps the DA declined to press charges because the evidence could not support a criminal conviction, however a civil case may well have enough evidence to stand up in court.
Rape is a very traumatic crime, and if she was indeed raped, this may be her only recourse to make her alleged attacker pay. It takes a lot of courage to stand up to the intense media scrutiny that is sure to follow this case as well.
Without knowing the details of what went on before during and after her alleged encounter, it's probably best to refrain from any sort of conclusions.

got accused of something like this when i was in high school by a girl i shot down...charges and everything. said it happened at school, turns out i was in a different state that day with my grandparents. it's unfortunate because a lot of people assume women are lying about these things because of false allegations. from my standpoint, she probably lying, because a lot of the accusations are just that....lies
