It does, but males slightly over the legal age having sex with willing females who are slightly under the legal age get charged with it all the time. The issue is determining at what age a participant can legally make the decision to have sex.

Well I guess my thought is just the reason it's rape is because they can't consent, because they aren't of the intellectual capacity. So whether they are willing seems to not really matter.
