And people wonder why America's on the decline.

Fall down on an icy sidewalk? I'm gonna sue.
I got fat after eating your food. I'm gonna sue.
Your kid ran into me with her bike? I'm gonna sue.

Dumb.

Exactly why I don't want to go to the Pinstripe bowl. :jimlad:

In other news, turns out that a judge in New York needs to be disbarred for negligence.

Are they going to take all her lunch money or what would they get for a settlement?

If I would was the defense attorney, my case would be based on my argument, "The old ***** was probably going to die in 3 months, regardless."

Even if the kid loses, couldnt the kid declare bankruptcy and it be off their credit report by the time they turn 18?

they struck an 87-year-old woman named Claire Menagh, who was walking in front of the building and, according to the complaint, was “seriously and severely injured,” suffering a hip fracture that required surgery. She died three months later.

This is ****-poor journalism at its worst. They writer makes it seem as though her death was caused by the injury that required the hip surgery. The lady was 87-years old! Unless it was medically proven that the hip injury/surgery did lead to her death. Then the writer needs to state that medical records show that her injury and surgery led to her death.

You make it sound like these things only happen in America (they don't). Take yesterday in Brazil for instance:

"Talk about an occupational hazard. A former manager of a McDonald's franchise in Porto Allegre, Brazil, was awarded $17,500 as recompense for gaining 65 lbs. over 12 years on the job, the AP reports."

People are always quick to bash America, damn Pinkos.

Hmmm...the article now says:

At some point in the race, they struck an 87-year-old woman named Claire Menagh, who was walking in front of the building and, according to the complaint, was “seriously and severely injured,â€￾ suffering a hip fracture that required surgery. She died three months later of unrelated causes.

If the girl is found negligent, some sort of liability coverage would probably be the goal, not her lunch money.

Childhood ends at four. How pathetic is our legal system?

Pretty sure according to this ruling Responsibilty begins at 4, legally childhood ends at 18. The question I ask the people who disagree with this ruling is what age does a child know the difference between right and wrong?
From the article apparently case law sets the age at 4 so the judge had to supress the motion, because the child was passed her 4th birthday. Now the stupid family who is suing a 4 year old is kind of ****ed up.

Not exactly ground breaking news, a five year old has been found liable for actions resulting in injury as early as the 1950's. Someone three months away from their fifth birthday is really not that big of a difference. That being said, as a society holding individuals this young liable in a negligence case may be questionable, however the finding of the judge is not really surprising.
