Wherever I go, there I am.
It actually makes sense. Iowa Code Section 124.407 requires more than proof that a person happened to be at a house where marijuana was used. There must be evidence they promoted or assisted in setting up the gathering with knowledge that the controlled substance would be used, possessed, or distributed there.

I wonder how many Ames student apartments the Ames police could search and not find more than a trace (if that) of marijuana? My guess is not many and after Fred has a good heart to heart talk with him the punishment should be minimal.

I hardly even drank let alone smoked pot until I was 21 and still had many times my clothes probably wreaked of pot in college just because of being out and about with people.

Living in LA I literally can't walk down the block without smelling pot. Not making excuses but knowing that BDJ grew up here and lived here not that long ago, pot is about a zero thing.

@skoenigsfeld: There is a trail pending regarding the city charges (noise nuisance/noise ordinance) and the charge for "drug house" was dropped because of insufficient evidence. According to Iowa Courts Online.

He definitely should not be suspended for a few games. That is ridiculous.

So...it appears many of you actually think BDJ wasn't smoking as well.

Where you there? He wasn't charged with smoking it and nothing came out saying he did. But if we are just going to make stuff up then he was also making meth in the basement. Thank god nobody found that. Nobody reported it and he wasn't charged for it, but I'm just going to say it happened because I can.

So..no probable cause... does that mean those bagging on the police were somewhat right?

That being said, BDJ, still probably time to invest in some headphones.

Not really - just that the court doesn't believe there's enough to continue. Dropping charges isn't a proclamation of innocence.

What is the maximum punishment for the noise violations?

This might have been discussed, but the original article mentioned a Search Warrant, can you really get one of those at 3am? Otherwise, can they just enter the apartment on suspicion without consent?

If he's suspended for anything more than the 1st half, then Fred is making the wrong call. Bad precedent.

I could see him getting benched for the 1st half....aka...make better decisions and don't put yourself in that situation. But for him to miss the full game is ridiciulous.
