West Des Moines police make hit-and-run arrest
West Des Moines police have made an arrest in a hit-and-run crash that seriously injured a man four months ago.

Just curious, how do they know he was intoxicated if the accident happened four months ago? What an idiot, hope the victim is doing better nowadays
OWI w/serious injury is a felony in Iowa, no?

Yeah it doesn't seem like it'd be hard to find footage of him sitting in a bar slamming drinks if they had a pretty good idea of the timeline/suspect. I also was here in 2010 at isu and have no memories of this guy.I would guess they went back and found out where he was prior. I wonder if if that helps in the defense of the hit and run

Still seems weird, wherever he was prior wouldn't qualify as proof he was intoxicated at the time of the accident. Either way, I can't imagine driving drunk would help his defense.I would guess they went back and found out where he was prior. I wonder if if that helps in the defense of the hit and run
credit card statements, cell phone data, bartender testimony4 months is a LONG time for security footage to still be around. Most places are on a loop back system. Nobody likes paying storage costs. Unless they were pulled and saved early on, good chance this footage is gone.
You would need all of that to make the intoxication part stick.credit card statements, cell phone data, bartender testimony

First to be clear I hope they throw the book at this guy and that he goes away for a long, long time.credit card statements, cell phone data, bartender testimony
No, but an effective prosecutor could sway a jury that there's no reasonable doubt he was sober. Depending on that information.First to be clear I hope they throw the book at this guy and that he goes away for a long, long time.
But, if I'm a defense attorney, none of those things prove he had a BAC over the legal limit.

My guess is his attorney will aske for a bench trial.Would the defendant choose to have a jury trial in a case like this? I'd think no, probably not much sympathy to gain.
