Just curious, how do they know he was intoxicated if the accident happened four months ago?

I was wondering the same thing myself. Not to take away from the gravity of the situation, but I'd be curious to see what evidence they are presenting to support that charge.

Yeah it doesn't seem like it'd be hard to find footage of him sitting in a bar slamming drinks if they had a pretty good idea of the timeline/suspect. I also was here in 2010 at isu and have no memories of this guy.

Yeah it doesn't seem like it'd be hard to find footage of him sitting in a bar slamming drinks if they had a pretty good idea of the timeline/suspect

4 months is a LONG time for security footage to still be around. Most places are on a loop back system. Nobody likes paying storage costs. Unless they were pulled and saved early on, good chance this footage is gone.

Still seems weird, wherever he was prior wouldn't qualify as proof he was intoxicated at the time of the accident. Either way, I can't imagine driving drunk would help his defense.

Hope the other guy sues the hell out of him and wins. I don't think much of people who injure others and run away.

The article I read said they had a warrant for his car the day after it happened. He told the police he thought he hit a deer. It’s not a case where they just found the guy four months later.

First to be clear I hope they throw the book at this guy and that he goes away for a long, long time.

But, if I'm a defense attorney, none of those things prove he had a BAC over the legal limit.
No, but an effective prosecutor could sway a jury that there's no reasonable doubt he was sober. Depending on that information.

Would the defendant choose to have a jury trial in a case like this? I'd think no, probably not much sympathy to gain.
