Deferred judgement w/ probation is a possibility and therefore, he wouldn't be a felon unless he violated the terms of his probation.

But hey pitchfork crowd, don't let the judicial system get in the way of a good ol' fashion burning at the stake.

The judicial system is finishing up with Mr Gary currently, and he is a convicted felon. If demanding complete accountability for a convicted felon that brandished a gun on central campus, is part of the "pitchfork crowd", then I am all in. I would guess that there will be significant communication directed at the prez`s office that could render Mr Gary`s stay at ISU a short one. Keep in mind, I could care less how talented of wr he is. He is a thug that needs to go now!

I did find this in the ISU code of conduct ------- clearly was an on-campus weapons violation:

4.2.14 Possession or Misuse of Weapons
Possession of weapons, unless authorized by the university, is a violation.
  1. A weapon is any instrument or device designed primarily for use in inflicting death or injury upon a human being or animal, and which is capable of inflicting death or injury when used in the manner for which it was designed. Additionally, any instrument or device of any sort whatsoever which is actually used in such a manner as to indicate that the possessor intends to inflict death or injury upon another, and which, when so used, is capable of inflicting death or injury upon another, is a weapon.
  2. Weapons include any pistol, revolver, shotgun, machine gun, rifle or other firearm, BB or pellet gun, tazer or stun-gun, bomb, grenade, mine or other explosive or incendiary device, ammunition, archery equipment, dagger, stiletto, switchblade knife, or knife having a blade exceeding five inches in length. Residents of university housing may possess knives having a blade exceeding five inches for cooking purposes.
  3. A "weapon" also means an object that is not an instrument capable of inflicting death or injury but closely resembles such an instrument (for example, a realistic toy, replica, imitation weapon or look-a-like gun that is reasonably capable of being mistaken for a real weapon) or the student used the object in a manner that created the impression that the object was such an instrument (for example, wrapping a hand in a towel to create the appearance of a gun).

I've never been part of the torch and pitchfork crowd. I'm not one that thinks that ISU needs to hold itself to a higher standard than its competitors. That said, you just don't do something like this on central campus. Central campus should be the safest place in the city...if not the state. If the university wants to boot him, I'd be OK with it. At the very least, I'd say a few more game suspension is warranted.

And if he is given probation and deferred judgment as part of the plea agreement he will only be a felon if he violates probation. That's right he could complete probation and NEVER be a felon according to the judicial system.

As long as he is gone from ISU, I really don`t care what the terms of his sentence are. Hopefully mass e-mails to Leath`s office will help ensure this outcome.

Clonestar is apparently on a rampage to make sure gary does not get a second chance at isu. Weird, creepy, and pathetic. Let pollard cpr, and the university figure it out, and get off their case.

Seriously, you should let it go...its not going to happen. He's likely to never be a felon the way this plea is going down, and he's already been punished as far as the football program is concerned...which you can be sure was vetted and concurred with through the administration. He'll get his probation and his punishment for having a BB gun tucked in his pants...and that will be that. I assume, Clonestar, from your vehemence you were either a victim or know the victim...either way, your vision seems to be clouded by personal animus. Gary will be playing in games 1-13 for the Cyclone football team this season. You should reconcile yourself to this now and save some heartache.

All I've gathered from this thread is that Clonestar12 is an absolute moron. And doesn't understand how the judicial system works, Iowa State's judicial procedure and codes, and the Athletic Department works.
