The lawsuits against various Android phones are a completely predictable move on the part of Apple. Awhile back in another thread, I posted some financial links regarding the US cell phone companies. For several months now, Wall Street has been telling US cell phone companies that their model of heavy subsidies for smart phones is not financially viable in the long term. The iPhone is the most heavily subsidized smart phone.
Several European cell companies have cut all subsidies for smart phones. In the European countries where this has happened, Android rules, and iPhone has minuscule market share (about 5%), because Apple has no low to mid-priced smart phones, while Android does. Likely, a similar thing would happen in the US if smart phone subsidies are cut.
Apple needs Android to be gone, so that there are no viable low-cost smart phone options should the US cell phone companies decide to cut subsidies. Apple is betting that the cell phone companies would rather pay subsidies to Apple for the iPhone than have large numbers of customers not buy/drop data plans because they can't afford smart phones. And it wouldn't surprise me one bit to see Microsoft supporting the Apple lawsuit behind the scenes, since with Android gone, the Windows phone would pick up some market share.
Until these lawsuits are settled, the cell phone companies probably won't make a decision on the subsidies, and Apple can keep stockpiling the subsidy cash.
