We do need to get ourselves out of the mindset that you need to blow over .08% to be impaired. Even if pills and marijuana weren't a thing, you could still be considered impaired if you blew under .08% but failed the other tests. I would think that is a pretty rare occurrence but honestly have no idea.

I'm not watching a 25 minute video, how did the kid do on the impairment tests? I'm assuming he wasn't otherwise visibly impaired (slurring words, unable to stand still, etc) since nobody has brought that up.

It sounds like he should have a pretty good case if it even gets to court

OTOH most of those field sobriety tests are garbage anyway and would make most sober people look guilty.

I had my cop relative give me a field sobriety test when I was really goddam drunk. The balance, touching nose, alphabet, walking, follow the light, time recognition...whole deal.

I passed and I was really really ******* drunk. The song and dance on the side of the road is garbage.

Yes and they are totally subjective. I have had them done, and even though I passed, still had to blow. I also have had them done and when I passed a couple they let me go.

I think the entire problem is we have about 20% of Cops that are total D-bags and just plain power trip horrible human beings, that should not be anywhere near that position. But, that being said we have 20% that are the exact opposite, that are probably the nicest, most helpful and damn near superhero cops. Then the other 60% fall in between that are just regular people doing their jobs, not particularly noteworthy either way, but may have a good day or bad day like anyone.

The problem is the 20% jackwagons are the ones that ruin it, the ones that need to get weeded out, and the ones that cause most of the problems. Those are the ones everyone has to look out for and those are the ones you need to be sure you have at least a basic understanding of your rights for.

I can say I have met all types. Majority being just the normal every day ones just doing their jobs, with the other 2 types occasionally.

Flip side, I once failed the hell out of all of em (I assume) and when the cop saw the breath measure he just looked shocked and said, 'you're free to go.' (.018)

I did that drunk goggle thing at a conference once. I couldn’t see anything. Cop said i had perfect testing on the line walk, I was just 6 inches to the side though. Said he’d never had that happen before.

It's never the cops with domestic abuse charges that you'd expect to be shitbags.

On a side note, I went to school with his mom. And now I feel really old.

Surprisingly, in my opinion, the issue isn't as much with the 20% D-bags, every occupation has some of those, it's the other 80% that either back up the D-bag (example, as his partner did) or simply keep their mouth shut and let that crap keep occurring. Just because you're on the same "team" and need to have each other's back doesn't mean you shouldn't have enough common sense to speak up (even if it's anonymously) to attempt to not let this crap occur.

Agreed. Most of them are, individually, alright people and some are great. Like with all groups of people. I've known some great people who are\were police officers.

The main problem is that most of those 60-80% will have the backs of the 20% who are bad at their jobs rather than doing what it takes to get those ones weeded out. Even worse, often if an officer does attempt to do something about another officer's misbehavior, they'll find themselves ostracized or worse.

All I thought to myself was, I don’t recall having this bad of vision ever in my life. Lines were literally crossing each other and there was only one line they said. I concentrated on my walking mostly.


Those drunk goggles are not even close to being really drunk. Your body adjusts to being drunk. Those should be renamed black out drunk goggles. This is what you will see if you are black out drunk.

I also failed every single road side test one time and passed the breath test. I expected to pass the breathalizer. I was not even drunk. I had one beer at a party and went home. Pretty sure the cop made up that I failed the road side test, much like the video. This was like 15 years ago though.

Since the 20% tend to win these things, it leads me to think that it's a lot more than 20%.

Because that would immediately be conclusive for alcohol. They don't want that, they want you to jump through hoops, hoops that the average person can easily slip up on even when not under the influence. Then they have the ability to say, "Judgement Call." even if you blow 0.00. Is it set up to catch impaired drivers, yes. Is it also set up for them to find another reason to arrest you even if you aren't intoxicated, yes.

Following the finger was a quick fail for me in a similar situation with a buddy who was formerly a cop.

Yeah totally. It seems they are no longer interested these days in law enforcement and are just really big into bullying and throwing their weight around. Pretty sad.
