If theyd all agreed to build that house, and in that agreement they agreed that if you leave early you will pay X as liquidated damages, they would pay X upon leaving (and it is set up that way in the big 12 bylaws, with the X amount being collected out of undispersed revenues first and then any amount beyond that is owed by the school leaving i believe)

Correct. And if party Y encouraged party X to engage in said breach, party Y is liable for tortious business interference.

The question would be, would that be enforceable?

Sure it would be enforcable. If 3 weeks from now the Big 12 holds a vote to increase exit fees to $100 million immediately and you have a vote of 9-1, then it passes. I don't know what % of votes you need to pass a measure, but I'm sure you don't need a unanimous vote.

Just set a deadline, and say get on the ship or get off it by a certain date or pay the penalty if you switch later on.

Seriously all a&m had to do was apply to the SEC and get accepted, if the SEC went after them and offered an invite then the legal bs comes into play.

A&m will pay breach of contract to the Big Twelve which is in the 30 mill range and that is it, and to the SEC they go.

A&M said the Big 12 contract is vague as to what they may owe. Is it?

They didn't read and understand the contract to which they agreed?

Heard that people in California do that all the time. Nebraska claimed the same defense when they left. I always just ask my attorney.

I liked this nugget from Stallings in his interview found here -->
Gene Stallings: Big 12 teams will be elsewhere; A&M saw opportunity

The SEC schools split their finances equally, while Texas controls the Big 12. Is money the main reason for the move?
"Had the television contract not come up the way that it has, I would be for staying where we are. But it did come up, it is going to happen, so personally, I'm for going to the SEC.
"A few years from now, there's going to be four major conferences, and there may be 18-20 teams in those conferences. They're going to have championship games and there will be a playoff of maybe the top four teams. I don't think the Big 12 will be one of those [super conferences]. Eventually they [teams in the Big 12] are going to be going to different conferences anyway.
"You've got a chance to get in one of those leagues, otherwise you're going to be left out. Going to be probably 80 teams in major conferences, and the rest of them are going to be playing for something else."

ISU will have a BCS home...someplace.

Stallings is a cheater, no wonder he likes the SEC so much. If there are going to be 80 teams in these "superconferences," how does this effect A$M? They are not even close to being on the bubble of the 80 most desireable.

There's no way there will be that big of conferences. There's really no need for the big boys to go past 64. They'll have their playoff and all the top schools. Why would they want to share it with another 16 schools? Stallings is just trying to make it sound like tearing apart the Big 12 won't be that bad for any of the Big 12 schools.

Iowa State will land into a BCS conference if the poop hits the fan. How can you go from BCS program to not a BCS program without there being legal and lawsuits behind it? How can you go the other way in terms of money and hardship.

The problem with the b12 isn't the tv revenue sharing agreement. I think the pac10 had a similar model, at least before they expanded. But how many times did you hear about pac10 instability?

And the sec shares but there is still a huge disparity between the budgets of Florida/Alabama and Mississippi State.

The issue is the power differential between Texas and the rest of the conference. I wish people would quit belly-aching about the money. That exists in EVERY conference - tv revenue sharing or not.

Here's how ISU gets into b10... We hire Jim Tressel to be our president. He seems to still be respected by b10 coaches, is currently available, and most importantly he can sway Jim Delany's opinion (see delany's stance on sugar bowl).

Plus free tattoos for faculty??

As I said before, ISU will never not be in a power conference, ever.

Think of it this way.

Currently there are 67 teams in BCS Conferences (counting TCU)
Then you still have teams like
Boise St
ND
BYU
Nevada
Hawaii

So if they went to 64 then they would have to cut 3 current BCS plus make room for ND and possibley others. I am guessing ISU would be one along with someone from the B12 or Big East. aka Decommissioned conferences. Its not going to be a team that already belongs...They can't just kick out Wash State, Illinois, NW, Indiana, Minny, Oregon State, Vandy, Miss St, Wake, Virginia etc....Teams like Baylor, ISU, Syracuse, Cincy, S Florida, L'ville should be the ones worried. TCU and Utah getting promoted actually hurt us a bunch. That is 2 spots filled.

So...If they were to go to 64....we are playing with fire and really need to hop on the Academic train.. show some fricking pride in sports the next couple years
If they go to 72 then we are good.

I really don't see how they could go 64 without a BUNCH Of legal troubles. You would have to throw out like 5-6 existing teams. I am guessing it would have to be 72 or 80. That woudl pretty much catch everyone.

But then....WHY EVEN DO IT? Just so you can make 28 million instead of 23?
