Deals registered from boosters and collectives will be automatically red flagged by Deloitte. Which is why there is a current mad scramble to get their deals done before the House Settlement gets approved later this month. For example, JT Toppin’s $4M deal with presumably oil man Cody Campbell which would not get past the Clearinghouse after House approval.

Deloitte has FMV comps up the ying yang and will focus on those booster and collective deals that are obvious outliers.
I have a feeling as soon as Deloitte challenges the first big NIL payment their “authority” will get tested. Why would Deloitte be able to tell Wilson Toyota of Ames that they can pay Tamin Lipsey $5,000 for an ad but not $50,000. Companies waste money on nonsense all the time. Now you could definitely argue that those payments shouldn’t be deductible as an ordinary and necessary business expense but the idea of telling private companies they can’t pay someone more than an amount set by an accounting firm seems flimsy

Really, all the business has to claim is that they thought it was going to be worth it. Advertising campaigns fall flat all the time.

What you describe is a very small part of the Cyclone offense. Typically, 2-man game with entry pass from the wing. The vast majority of our half-court offense centers around high ball screens- either PnR, horns or weave action.

Our offense was clicking when Gilbert and Lipsey were driving the paint and either finishing at the hoop or flipping it out to a jump shooter on the 3 point line. So if he's a guard who can get in the lane, opponent wing defenders have to collapse to help, giving perimeter guys open shots.

IMO with recent recruiting TJ is bringing in bigger guards to have the quickness and athleticism to finish in the paint strong. And being a 6'5" guard would help in that respect. Gilbert was solid at finishing in the paint because he was like the rubber band man with a knack for creating contact or making some crazy shot. Lipsey has a talent for using his strength and body to score close-in.
And both Gilbert & Lipsey got injured and beat down when it counted at the end of the season. The Natty game was a knock down no holds barred war. Unless the officials start calling contact on defense, if you go in the paint on a mission you’d best be strong enough to make a play. Because you’re going to get mugged.

Totally agree
I may be slightly misquoting a CPA I know quite well - but FMV can be interpreted as the price someone is willing to pay, that is accepted by the seller.

I think some (many?) would disagree. People pay over FMV all the time for things that are of particular value to them specifically. FMV is the price that the open market would bring from a willing buyer who's informed and acting in their own best interest. It's pretty obvious, based on loads of market data, that local car dealership would not be acting in their own best interest (as a busniess) to pay someone 10x what is "normal" for a comparable marketing deal.

Now it'll definitely be challenged in court. Whether it'd hold up or not, we'll see! Deloitte doesn't get to tell a dealership what they can pay but, if approved, the NCAA may have the ability to tell a player what they can accept if they want to be eligible to participate. Then the same deal is never going to be on the table if the player can't participate.

But there is no “normal” here to say it’s 10x normal

Celebrity endorsements are a highly non-standardized, illiquid product

It’s more akin to trading cards. The buyside for that specific nil package sets the market

I guess I'm not shocked anymore but Darrion Williams just entered the portal. Probably wants Toppin money but I cant believe TTU cant pay to keep him, they probably would prefer to keep Anderson.

The clearinghouse is around to really weed out donor payments. Legitimate NIL for advertising will be fine. Also, corporations might be hesitant to contribute out of risk for being rejected by the clearing house (or even bothering with it).

I think it’s interesting the power 4 are setting up an entity OUTSIDE THE NCAA to set up penalties and enforce the NIL rules.

The main focus for Deloitte will be to ID and differentiate what is "True NIL" at FMV vs blatant Pay for Play. Based on what I read, there will be an arbitration process if a deal is not approved and the NCAA will be out of that process. It should be noted that during Monday's House Settlement hearing that the NIL Regulation language in the Settlement was not disputed and will be intact for the Judge's final approval.

I doubt Deloitte will nickel and dime the vast majority of deals. They will likely rubber stamp any deal within rational boundaries from non-boosters. Deals from boosters engaged in a legit business venture will be reviewed if they are an amount of any significance. Deals from collectives will likely be outright rejected regardless of amount.

I am going to assume that JT Toppin's reported $4M deal is primarily funded by booster Cody Campbell who recently sold all or the majority of his oil companies. That deal would obviously not get past the Clearinghouse upon House approval nor would Robert Wright's $3M deal with the BYU boosters/collective.
Now if Cody Campbell buys a car dealership and engages Toppin in a deal with that dealership at $4M, that deal would obviously get reviewed by Deloitte and FMV comps for similar deals would be used by Deloitte to presumably reduce the value of the deal or outright reject it. So while Campbell may consider it FMV from his end even though it is blatant Pay for Play, the intent of the Clearinghouse will be to utilize their vast library of FMV comps to moderate or reject those type of deals.

He's one that is entering the portal and testing the draft waters. It's probably even odds that he goes to the draft, comes back to TTU or goes somewhere else.

They had to set it up outside of the NCAA in order to provide the enforcement arm some semblance of subpoena power which the NCAA never had and completely neutered their enforcement efforts unless there was obvious evidence made available (without subpoena) or witnesses who would willingly volunteer to talk to NCAA enforcement.

That makes sense. The power 4 really want the booster money going in-house again. Especially being they are on the hook for $20.5M in revenue sharing.

TT reported to have paid Topin 4mil to pass on the NBA for a year roughly a late 1st round pick money. If they are willing to spend that I have a hard time believing they wont match a 2nd round pick money Williams is looking at. TT's boosters are going for the Natty they need Williams and he knows they'll pay for it.

When does the dead period end? The silence is driving me nuts. Do you think we will take one or two more transfers? I know we have the Utah Valley guard visiting this weekend.
I guess I don't understand the point of the dead period. It's not like they are not talking to the kids still. Also, didn't Chris Williams say the Utah Valley guard was not actually being recruited by Iowa State? I am kind of confused on that one.

Only the poor P4s

The P2 want new money like Tech and Creighton put back in the box, in a setup like FMV which favors the traditional, old money, big brands

It is just so the coached don't have visits scheduled during the Final 4 and they can attend.
When does the dead period end? The silence is driving me nuts. Do you think we will take one or two more transfers? I know we have the Utah Valley guard visiting this weekend.
Portal Closes April 22nd. That just means you need to have your name in if you potentially want to transfer though not that you have to be committed.
Big date for ISU just incase there are any more back door offers still being sent.

Local companies owned by rich "boosters" will overpay. The Jerry Jones wannabes will always write a check to be important and have access.

But we have also been through a strong economy. Throw a recession in and smaller or local companies (aka Wilson Toyota) might find it tougher to throw $50k at an athlete when $10k will work.

What about large corporations? Right now we are in the wild west of NIL, but things will settle down. And marketing folks who write the checks will realize they are wasting money on most Athlete Spokespeople. 80% of the commercials with NIL athletes (even Pro) I have no idea who the athlete is! They'd make a better investment hiring another Terry Crews. Or they need to be like Experian and tell me who Flau'jae Johnson is:)
