I'm not even getting into it, seems as if on the top of Bubu's ridiculous amount of flaws - he's also sue happy.

You can believe whatever you want, if you all still think he's a good kid that got a tough break, nothing is going to change your mind at this point.

Also, don't believe for a second that the majority agrees. Maybe the majority on this website of fanatical types, but not out and around those that are actual normal people.

I said nothing about him being a "good kid". Here's what I know, he hooked up with a girl, who he had previously had consensual sex with. The girl at the time of the hookup in question was dating a different guy and the girl also fabricated evidence. The case was dropped due to lack of evidence. And Bubu won a suit against the girl for defamation.

So based on the facts I know I feel ISU/Leath did him wrong. Hooking up consensually with a girl who has a boyfriend isn't a crime and isn't enough to get you suspended from participation in athletics.

I think this thread is more silly than stupid. There is plenty of stupidity in other threads and they aren't even trying.

No, I think he was right. Most threads don't victim blame and call sex "consensual" when a female was so drunk she couldn't stand up straight, and two dudes still double-teamed her.

I agree with CyDude - lol at Bubu losing opportunities due to ISU. He was a walk-on who couldn't get a scholarship anywhere else, we gave him a scholarship, which he lost by being an idiot. Whether or not it was rape, he was an idiot.

Mike Taylor didn't whine and complain because McDermott kicked him out for ganking cough syrup. Later on he praised ISU and the decision, calling himself stupid. Some people just are a little better at self-reflection than others.

The bolded doesn't matter even a little, and is another attempt to victim-blame. A wife of 50 years can tell her husband "no" to sex, and it's still rape if he forces it. (And vice versa with a woman forcing herself on someone.)

I am not sure how you can scream blame the victim when it is a FACT the victim fabricated evidence.

And yes while prior consensual sex doesn't automatically mean the time in question was consensual it does show that they had prior consensual relations and possibly did again despite her dating someone else.

Wasn't Leath's whole issue lack of explicit affirmative consent as required by the student conduct code, which is a different standard than the Iowa criminal law standard?

Angie, I don't think it's an attempt by Curt to "victim blame". There is no doubt that poor judgment was exercised...but I don't think Bubu was the only person exhibiting poor judgment that night, or in the days following. You gave the woman a pass for being "so drunk she couldn't stand up straight". There seems to be a double standard at play here.

The university, athletic department, or basketball program may have a conduct policy that is different than simply lawful or unlawful activity. That policy may indeed make ISU more susceptible to litigation than just a generic legal illegal argument. In practical terms, Bubu may be innocent in the legal system, but may still have violated policy that caused Leath and BOR action.

And I'm not sure how fabricating evidence automatically means she's not the victim. I'd gather you've never been the victim of sexual assault, or close to someone who has - in cases of "he said, she said" (or, deplorably, "he said, he said, she said" in this instance), obviously the onus is on the victim to provide evidence of it. Which is good, assume innocent until proven guilty. But this means that victims often feel forced to embellish so that there is something tangible, something that means their assailant will not get away free. All that fabricating evidence said here for sure was that she made a bad decision of her own.

Again, prior consensual sex has absolutely no bearing on this case. It's like bringing in testimony that John Wayne Gacy did charity work as a clown, so surely he couldn't have been a mass murderer. Previous acts do not have anything to do with whether or not there was a crime.

Nobody wins... The guy gets sex which probably started out consensual and the women develops a different perspective in hindsight and regret. The guy is labelled a rapist and even if exonerated the taint stays with you.

Yeah I think every guy would try and exercise some judgement with what's at stake.

So, getting drunk means that someone deserves to be raped? Getting drunk is not a criminal offense. Penetrating someone who is too drunk to consent, on the other hand, is.

Thank you. In no way am I trying to blame the victim here. Was poor judgment used in this situation? Yes by everyone involved.

I have a contract sitting on the edge of my bed that a girl must sign in three different spots giving me consent before anything freaky happens.

So far, no girls have seen that contract.

Give them the roofy-colada earlier in the evening.

That joke is in very bad taste but it is the age we live in. No means no. Hesitation means no.
