Here's what I will say. Regardless of whether or not the right decision is that Bubu did something wrong and should therefore be punished, I feel like it is pretty clear Iowa State and Leath were wrong in how they handled the situation. There is clearly some sort of lost wages that Bubu can claim, how much is a different story.

Now to the much more complicated and contentious part. I have always been of the opinion that if innocent people are being punished we don't have a high enough standard. Now we can argue about the specifics of the case, but I think that this has brought up a very important issue when it comes to student discipline and sexual assaults. If we have even one person being sexually assaulted on campus or in our society that is to many. Lowering our standards of evidence and the likes isn't going to solve it. All that does is create more confusion on who is guilty. Also once an assault has happened punishing someone isn't going to make it so the assault hasn't happened. It happened and that sucks, but it did so now we have to deal with it. Just finding someone who we think may have assaulted someone and punishing isn't dealing with it. All that does is possibly create another victim. Now if they did it obviously punish them, but make sure they did it.

Now to get into the details of the code of conduct.

This is from the Iowa State code of conduct. Now I am by no means a lawyer and I don't know if the athletes have their own that addresses it differently, but it doesn't require a verbal yes like some have alluded to.

Maybe out of decency and respect for the victim after she was raped (an actual victim and raped as reported by the ALJ) a guy could maybe not screw her especially if she was as drunk as posted (posted - not reported).

Doesn't anyone have a moral line or basic instinct to protect the defenseless that should kick in?

Okay, that was answered after all.

Was Bubu the rapist? That is the core issue at hand, leading to the rest of the cases and these arguments.

Bubu didn't rape "technically" you're saying since it was the guy IMMEDIATELY PRIOR to him that brutalized her. So no harm no foul next man in?

Why no common decency? No humanity or compassion for her? They were friends at one point. How many here would do that to a friend - if what has been posted (and reported) is even remotely true?

Argue technicalities with contract law... This girl was raped and Bubu was there.

Wow, I love Bubu threads. They are so civil and no one comes off as condoning sexual assault at all. :jimlad:

Whatever Bubu did do, he was stupid. Did he deserve what happened to him? That's debatable, but it's sad to see people paint him like a saint or act like it's what all college kids do. The whole story is sad and it's been beaten to the ground more times that almost anything on this site.

Nobody here has argued anything with the morality of this situation. Literally everyone in this thread has agreed that what happened was a large culmination of stupid and immoral moves.

You're accusing Bubu of rape. The court already decided there was issues with that. I didn't realize Bubu is the next OJ Simpson. Wouldn't you logically think that if he really did rape her, he wouldn't have won a defamation suit against her saying that he did?

We have no proof or idea whether he knew it was a rape or not at the time. We never will be able to prove that either way.

And, yes, arguing technicalities with law is what's happening here. That's what the court does: define law, and prosecute those who break it. The criminal court doesn't judge based on speculation.

Apparently seeing differences in law == endorsing rape, as Linden and others pointed out. However, the rest of Linden's point is true: it was a stupid move that directly caused all of his issues.

Wow. The ALJ mentioned that the victim was traumatized.

Isn't that fairly obvious given that she later reported it as rape? Was she traumatized at the time the event occurred? There's a lot of variables about the event that aren't being answered here, and thus, is remaining as speculation.

If it was so cut and dry, what provoked her to tamper with evidence in order to help her case? That was ultimately the deciding factor.

No, not necessarily, but some comments made in this thread sound like they might be endorsing/painting a grey area around sexual assault which has nothing to do with the Bubu case specifically, but does come up every time this stupid topic gets bumped up.

I actually do wonder what the settlement was for; it doesn't necessarily mean it wasn't much, but apparently it wasn't enough to Bubu to have some closure of the event. Or, he just really wants more money. I still don't think he's going to win anything of value (or win at all) against ISU.

Will be an interesting case. Because he did basically lose his senior year because of this but I have no idea what that will translate to.

No, I think he was right. Most threads don't victim blame and call sex "consensual" when a female was so drunk she couldn't stand up straight, and two dudes still double-teamed her.

I agree with CyDude - lol at Bubu losing opportunities due to ISU. He was a walk-on who couldn't get a scholarship anywhere else, we gave him a scholarship, which he lost by being an idiot. Whether or not it was rape, he was an idiot.

Mike Taylor didn't whine and complain because McDermott kicked him out for ganking cough syrup. Later on he praised ISU and the decision, calling himself stupid. Some people just are a little better at self-reflection than others.

Agree with this 100%.
