I can understand how it would really suck to have to come home and deal with that smoke smell, so I don't think you are being ridiculous at all. I just don't think there is anything you can about it, but to move.

Good luck.

Just because some people aren't really affected by smoke doesn't mean others aren't. And it can be a big problem/issue with those of us whom it does affect.

+1. If second hand smoke doesn't bother you, be thankful.

My dad smoked cigars regularly until he was about 40 (his dad smoked them his entire life). When my dad hit 50, somehow he developed significant allergies to second hand smoke...runny eyes, runny nose, immediate sinus congestion, and headaches. Second hand smoke drives me nuts now as well, when it didn't in the past. Just becasue it doesn't bother you now doesn't mean it won't bother you in the future.

My wife is extremely sensitive to cigarette smoke; she might react in an environment where I can't smell a thing. Definitely depends on who you are.

The OP is in a tough spot, but I don't know what you can really do besides put up with it. As long as the smokers aren't breaking the law, they have the right to light up. Doesn't mean they aren't jerks if they couldn't care less how it affects you, IMHO.

At my old house in Iowa City, I had a neighbor that smoked. It wasn't the second hand smoke that irritated. It was the butts he would flick over in my yard. Every time I confronted him, he would go on the defensive, like they didn't belong to him. In the end, I would pick up the butts, mix them with my cat's litter, and spread them on his front porch. He quit flicking his butts into my yard.

I have a 17 month old daughter and live in an apartment building. Something I am deffinetly not proud of as I hate raising her in an apartment setting with all these rug rats running around. Anyway, this is the second set of neighbors I have had that do nothing but sit outside all night and smoke. This is really only a problem two months out of the year when I want the windows open. I grew up in with parents who smoked but were very respectful around others and me. I understand smoking but when do I draw the line and freak out?

What sort of line do you think you can draw? If your fellow tenants aren't breaking a law or a violating a condition of their lease, you are SOL.

Sorry that you're inconvenienced two months a year but that sort of comes with the territory. Tolerance is probably the best policy when you live in an apartment...

Come on people...this is America. Smokers and smoking are public enemy #1 in this country. These filthy, vile smokers should be all be locked away in prison.

Seriously, did you ever contemplate the fact that maybe your neighbors don't enjoy all of the noise that a typical 17 month old child produces?

This. So I suggest a microphone and hook it up to speakers aimed into their apartment when she wakes up in the middle of the night. Annoying and easy to hide when the landlord comes.

If their patio is next to yours set up a fan with a motion detecting outlet plug and blow the smoke back at them. That will at least get them to realize it's a problem.

I'm one of the people that are affected by smoke. I know that doctors will tell you that small amounts is not harmful, but it does give me bad headaches if I am around it. I feel your pain.

Are you seriously comparing the noises made from a healthy child to smoking?

One is natural order, and the other is unhealthy choice.

Nice try, though.

So your neighbors are smoking outside of their own apartment building, on their own porch? And you feel you would/should tell them to stop smoking outside of their own building on their own porch?

I think you are the one with the problem in this case. Unless they are breaking some rule at your complex I don't see that you have any case. They pay their rent the same as you and it is their deck or patio or whatever. I am surprised that it would come back into your apartment as smoke from outside usually wouldn't come back inside in any quantity, you must have some funky wind currents around there.

Does smoke not like the indoors or something?

It is a fair comparison in this case, as he is talking about annoyances, not their place in the scheme of things. They are very comparable as annoyances. Personally if I lived in an apartment I would rather be surrounded by chain smokers than annoying babies and toddlers.

I have never seen anyone smoking outside, where the smoke blows back inside the building. It usually rises up and then dissapates. Sorry I just haven't seen that much, thus I figured this dude probably had some weird air currents blowing around his patio. There are 3 people smoking outside of our office right now and it is not blowing back inside, which is normal.
