As much as I don't like it, you can make an argument that the offending parties in their offical capacity receive some state money. Therefore, they are at least in part state actors, which might render the state partially liable. In theory at least.
I know... There's good reason why lawyers are so beloved.
Don't forget about this deal the BOR made with Iowa. We as taxpayers could be on the hook for this debacle also. Which is significantly more than the 2 mil on this settlement.

The chickens have come home to roost and this problem had its roots sewn decades ago all the way back to the Hayden Fry era. Also true, but I feel like the key here is that there is a feeling among many that this was the understanding when he was hired as AD, and it was all but written into his contract that he was to do exactly as he did.
