I looked up the actual code referenced by the student code and Iowa cide for legal consent and it said a person "mentally incapacitated" cannot give legal consent. This is the definition of incapacitation in Iowa code.

"Mentally incapacitated" means that a person is temporarily incapable of apprising or controlling the person's own conduct due to the influence of a narcotic, anesthetic, or intoxicating substance.
Given she called Bubu for a ride, remembered details etc. I am not sure she met the legal standard for incapacitated. So honestly I am not sure what the University had to go on. Unless there was other evidence beyond the fabricated evidence that supports the victims story of forcible rape I don't get it. Given he was not dismissed from school I would speculate he was not found guilty of rape or sexual misconduct but rather some other vague part of the athletic code of conduct regarding representing the University in a positive light.
It is unfair and speculative to assume he was found guilty of rape by the university. I shouldn't of inferred he was guilty of sexual misconduct either.

I do think he was guilty beyond any reasonable doubt of being a dirtball though. They can kick him off the team for whatever reason they want and they did for reasons we may never know. However, I suspect more will come out. With his dad working for the University am sure it is rather sensitive but if it was dismissal for any reason besides sexual assault you would think he would want to make that clear.
The University followed its protocol to a T. The only failure is Bubu's failure to act like an upstanding and decent member of society.

If that is your definition of a good person (or rather, something you would look the other way on) then I'm going to have to disagree with you. Bubu screwed up, and the worst thing that happens is he gets kicked off the basketball team where he started as a walk-on. Dude had no chance to make an NBA roster so really, what's the big deal? I'd be much more concerned with all the crap the girl involved has to put up with than what some spoiled stupid kid did.
