Right, and in some cases they have larger alumni bases and larger TV markets. it’s crazy, we took the four we had to just to survive and it’s paying off. Do you really think Espn and Fox are going to "work together" in any shape or form when it comes to any of this? They are the definition of enemies in this. Same goes with The SEC and B1G.True, but ESPN and OuT EXPECTED the Big12 to dissolve. It didn't because the R8 were both angry and desperate enough to hold together.
If this is tried in the ACC, they (ESPN/Fox) will plan better - ie get 4 teams each to SEC & B1G, and those 8 are enough to dissolve. They might even talk to the left behinds beforehand and tell them not to panic, soft landing spots available in Big12.
So it's not getting past he GoR, it's eliminating them beforehand with smarter prep.
That still takes years of litigation and negotiations to get to a settlement.Because letting the GOR expire gets them nothing. Letting it get to court a nonzero risk of disaster and if they win, right back to a dead ACC with no chance of that changing. And enough schools agreeing without you, resulting in dissolution, likely a years long court drama in which you’re playing in lower than the American while it’s settled.
Settlement is not only the safest path, it is their only way to leverage the GOR for altering their realignment fate and pay.
A slight premium to the horrible 2016 era deal and a spot in the 3rd super conference is an easy decision. They should be asking for ACC to be made the base of 3rd conference, which given ESPN’s low offer on keeping PAC together, isn’t yet out of question.
If espn was our sole rights holder for next 14 years, you better believe we’d sell OUT for free to have ESPN kill PAC and ACC, roll their leftovers to Big 12, and giving us a premium to balance of our deal. We’d likely give up the premium if needed. Hell, we’re likely still trying to give OUT away for that

If you get advice from a lawyer that you should pass on a favorable settlement in favor of risking everything for best case of “didn’t lose”, because they tell you it’s an “ironclad” legal document, or something to that effect, find a different lawyer

They will both want the same schools, they will both want the same values. etc. No way they sit down together and take turns picking teams or some crazy thing like that.
The agreement that ND signed to get into the ACC states that if they "ND" ever join a conference, it must be the ACC. So if ND decided it was in its best interest to join the B10, they would have to buy their way out of their ACC contract.SIAP, Pretty sure if ND is out of the ACC it only takes 7 to dissolve ACC.
If all the schools have a landing spot then this might work. It would take cooperation from the Big10, SEC and Big 12, but if the Big10 and SEC each take 4 that will leave 6 schools on the outside. If the BIg12 could take all six remaining, particularly if the $$ for the now expanded Big12 are better than the existing ACC contract then the six remaining schools would have a difficult time showing damages even if they wanted to enforce the GOR.There are only two realistic scenarios for leaving the ACC. 1, they leave when the GoR expires. 2, enough of the schools know they have a better landing spot and vote to dissolve the ACC.

Overall my point was more along the lines of the mid tier team in the conferences are getting pretty big heads because they get the money and could compete with the higher ups, so they act like they're the chosen ones or whatnot. Some of those teams are going to be left behind once Alabama gets sick of footing the bill for Vandy or someone comes calling and tells them, Georgia, Florida, Texas, Oklahoma, Clemson, and Florida State(for example) that they'd pay them even more to pair up with the Big 10s elite to form a coast to coast superleague, but this time without needing to include Northwestern or Purdue.

It would lower the risk but there would still be a potentially nine figure lawsuit by the Wake Forests assserting that they own the broadcast rights to Ohio State at UNC or Alabama at FSU.
