Look, I agree. People who say that 'She was asking for it' are ******* stupid. There may be a trail of communications throughout the day, but that doesn't indicate in the moment of passion if the victim actually wanted to proceed or not. I agree with you there. But...I didn't mention this anywhere in my post. You literally skipped my entire point where there were obvious missteps by the victim which prevented any momentum of proceeding against Bubu or that other kid legally. In fact...as I mentioned above, it could be inferred that if you are 'MANUFACTURING' evidence, there is a good chance you could be lying about the whole thing. Now..I understand that you want to side with a victim, and I think ALL of us in here would. The problem with this victim is that when you LIE to police, and don't pretend that she didn't, then there is a strong liklihood that your credibility will be shot. THIS is what has happened here.

Also...you don't think that Leath mis-handled this situation? You don't think Bubu at least deserved an answer so he could have known whether or not he needed to transfer? I mean..you keep arguing that the punishment wasn't that much..and ISU did MUCH more for Bubu than he ever did for us. Seriously..how is that even relevant? Honestly? All Leath needed to do was to notify Bubu of his punishment BEFORE the transfer period was over and this wouldn't even be a problem. But....he chose not to, and as such he cost Bubu an entire collegiate season. Leath's mishandling of this case is problematic, and IMO Bubu has standing to sue because of it.

I have said probably a dozen times in this thread that the victim was an idiot to tamper with evidence. However, I do not think that automatically implies that he's innocent - you will find that many victims do that out of desperation, given the current acquittal rates for sexual assault.

I don't think anyone owed Bubu anything. Not after the decisions he made. I believe Leath didn't want to rush to judgment here, because it WAS a huge decision. And what everyone forgets is that Leath isn't stupid - he knew that there would be a large number of people who would be ****** at kicking Bubu off the team. He knew that it would make him unpopular with some. You don't get to be the president of a major university by being dumb or vindictive, or bad at marketing - so, something in the evidence that he saw that we didn't was compelling enough for him to make a decision that would be unpopular. That's just Occam's razor. Claiming this is all some conspiracy against Bubu is tinfoil hat-level b.s.

So 20k a year, he was delayed a year and a half from playing in the D League. If he makes 25k then he's owed more. So he is owed 30-37.5k, correct? I'd sue too.

Did the transfer rules somehow prevent him from going to the D-league over that 1.5 years? Do you have any links for that?

Even smart people can make bad decisions, and Leath made a bad one. Bubu was already cleared by the legal system, not a good decision to go against that decision by Leath.

Why do I need a link for that? He didn't play for a year and a half when he could have and lost his senior year in college. Maybe we should pay him 50-62.5k then for his senior year too.

REAAACCHHHHHH

REEAAAACCCCCHHHHHH

Nope. No where did he say that.

It's hyperbole, same as saying that Bubu had any shot at playing in Europe out of Iowa State. Or now, apparently, for that matter.

Victims tampering with evidence to avoid acquittal is not helping the acquittal rate in their favor, as seen by this case. That behavior should not be defended or encouraged.

However, you're right about the"University conspiracy" thing -- that's pretty ridiculous.

LOL. One of the biggest stars ever in the NBA played his last game last night. I think he was still making okay money despite being a rapist.

Let's not pretend that professional basketball players are held to the same standards as someone working at State Farm.

If Kobe Bryant had been a borderline professional player it would have affected him a lot more than being an already established NBA superstar.

The professional ranks sometimes overlook checkered pasts, but only if they think the player is really good. Marginal guys get passed over a lot if they have a history.

Also Angie, I just want to take a moment to commend you for arguing this topic in good faith for so long. Usually, stuff like this would have devolved into useless speculation and silly name-calling long before this point.

No, I'm asking why he didn't go to the D-league immediately after Leath told him no. As far as I can tell, this last year was Bubu's first year in the D-league. I am gathering the magical year and a half that he lost was between Leath's decision in summer 2013 and 2015? It's been reported in this thread that he was apparently outshining Korie Lucious by this time, why wouldn't he go straight to the D-league? I believe he stayed here in Ames to fight the battle in court, correct? That was his decision.

I don't think anyone at all would defend or encourage that. It's a dumb move, and hurting the cause.

only thing I might add is that I doubt Leath acted autonomously. I'm sure he conferred with legal counsel prior to any decisions.

Marginal pasts also don't get overlooked if you are a marginal player.

So pay him for his time he had to waste on that nonsense as well as legal fee's. That's why he is looking for compensation.

The judge who dropped the case on a technicality had some fairly dour words for Bubu, which were posted upthread. The university has its own code of conduct for its representatives; their investment in the situation is greater due to marketing and safety, hence it being more damaging to support Bubu if he screwed up again.

Right -- the University never had any interest in protecting or helping Bubu (or really the victim, either, for that matter), their prime directive was to clean the University's image by any means necessary. And, due to their code, they can more or less do just that. That's why I'm not totally sure Bubu will get anything from this.

But, he has at least a somewhat compelling argument to go for it.

Is there a way to be supporting Bubu's angle without being a "Bubu fanboy", in your opinion?

Sure.

Nope.

Just like I'm an alcoholic for drinking one beer.

Um, no, and you seem to be taking this personally. There are a lot of people posting in this thread and some have said some things that just jump to Bubu's defense. The people who don't fall into that category seem to be the ones getting defensive though.

I think Bubu has the right to sue and I think there were probably errors in how this was handled on all sides, but these threads always develop into a very polarized discussion in which some people assume Bubu was railroaded (he wasn't). He may have been wronged, but he wasn't screwed over in some cosmic sense.

Heads in the sky
the negative stigma of being accused as a rapist, kicked off a Div.1 bball team and then let go?

Not sure who you hire but in most industries, HR tends to do things like background checks and weird stuff like that...and whether or not it's legal to do so, people don't get hired or get the benefit of the doubt when things like that happen to them.

so you don't have any proof it prevented him from pursuing a job outside of basketball? Got it.
