Look, I agree. People who say that 'She was asking for it' are ******* stupid. There may be a trail of communications throughout the day, but that doesn't indicate in the moment of passion if the victim actually wanted to proceed or not. I agree with you there. But...I didn't mention this anywhere in my post. You literally skipped my entire point where there were obvious missteps by the victim which prevented any momentum of proceeding against Bubu or that other kid legally. In fact...as I mentioned above, it could be inferred that if you are 'MANUFACTURING' evidence, there is a good chance you could be lying about the whole thing. Now..I understand that you want to side with a victim, and I think ALL of us in here would. The problem with this victim is that when you LIE to police, and don't pretend that she didn't, then there is a strong liklihood that your credibility will be shot. THIS is what has happened here.
Also...you don't think that Leath mis-handled this situation? You don't think Bubu at least deserved an answer so he could have known whether or not he needed to transfer? I mean..you keep arguing that the punishment wasn't that much..and ISU did MUCH more for Bubu than he ever did for us. Seriously..how is that even relevant? Honestly? All Leath needed to do was to notify Bubu of his punishment BEFORE the transfer period was over and this wouldn't even be a problem. But....he chose not to, and as such he cost Bubu an entire collegiate season. Leath's mishandling of this case is problematic, and IMO Bubu has standing to sue because of it.
I have said probably a dozen times in this thread that the victim was an idiot to tamper with evidence. However, I do not think that automatically implies that he's innocent - you will find that many victims do that out of desperation, given the current acquittal rates for sexual assault.
I don't think anyone owed Bubu anything. Not after the decisions he made. I believe Leath didn't want to rush to judgment here, because it WAS a huge decision. And what everyone forgets is that Leath isn't stupid - he knew that there would be a large number of people who would be ****** at kicking Bubu off the team. He knew that it would make him unpopular with some. You don't get to be the president of a major university by being dumb or vindictive, or bad at marketing - so, something in the evidence that he saw that we didn't was compelling enough for him to make a decision that would be unpopular. That's just Occam's razor. Claiming this is all some conspiracy against Bubu is tinfoil hat-level b.s.
